Generally, the Michigan Department of State will revoke the driving privileges of someone convicted of two drinking and driving cases (or driving under the influence of controlled substance cases) within 7 years or three within 10 years. DLAD hearings consist of an appeal hearing before an Administrative Law Judge (hearing officer).

The goal at the DLAD is to win; however, if a hearing officer denies a license restoration appeal, the hearing officer’s ruling can be appealed to a circuit court. We are often hired by people who lost their appeal with other, less experienced lawyers and need new and effective representation for a circuit court appeal. A recent change in the law gives an appealing party more options in the circuit court.  The petitioner can now ask the circuit judge to accept new evidence or new testimony during the appeal process. The ability to admit new evidence is essential when the record and evidence introduced at the earlier DLAD hearing was insufficient.  The key is a lawyer who knows what evidence is most persuasive and creates the most effective record.

Michigan DLAD Request for Hearing

A DLAD or DAAD appeal for restricted or full driving privileges starts with a “Request for Hearing.” The Request for Hearing is filed with the DLAD. It must include an affidavit from the petitioner, a substance abuse evaluation, a drug and alcohol test, letters of community support, and more. There must be a Physician’s Assistant and a Breath Alcohol Ignition Interloc Device Report (BAIID) in some cases.
