A recent change in the law gives an appealing party more options in the circuit court. The petitioner can now ask the circuit judge to accept new evidence or new testimony during the appeal process. Michigan DLAD Request for Hearing
A DLAD or DAAD appeal for restricted or full driving privileges starts with a “Request for Hearing.” The Request for Hearing is filed with the DLAD. It must include an affidavit from the petitioner, a substance abuse evaluation, a drug and alcohol test, letters of community support, and more. There must be a Physician’s Assistant and a Breath Alcohol Ignition Interloc Device Report (BAIID) in some cases.
